What type of personal data do we collect?

If you are a client, we will process the following data:

When you apply to work for ALIGN, we will process the following data:

Contact and identification data: first name, last name, address, age, email address, phone number, nationality.

Data to assess your application: degrees, certifications, professional experience, previous companies, language skills.

If you are a potential prospect, we will process the following data:

If you enter in contact with ALIGN, either by sending an email, contacting us by phone, or via our Website, we process the following data:

ALIGN does not process sensitive data relating to your health, ethnicity, philosophical, political opinion, religion or beliefs, or trade union membership unless it is strictly necessary, for example, if these data are relevant to analyze or defend your legal position.

This processing purpose is based on the legitimate interest of ALIGN. To this end, ALIGN strives to maintain a fair balance between our need to process personal data and the preservation of your rights and freedoms.
Management of applications	ALIGN collects data from candidates applying to work with ALIGN, to assess and follow up on the application.	The processing purpose is based on legitimate interest. To this end, ALIGN strives to maintain a fair balance between our need to process personal data and the preservation of your rights and freedoms.
Archivage	ALIGN is required by law to archive its files when they are closed and those files can contain personal information data entrusted by the clients.	This processing purpose is based on ALIGN’s legitimate interest. Management of contact’s requests	ALIGN collects the personal data from the persons contacting the law firm by email or phone, or via the Website.	This processing purpose is based on ALIGN’s legitimate interest. Management of data subject’s requests	ALIGN collects data provided in the context of the exercise of data subject’s right.	This processing purpose is based on ALIGN’s legal obligations.

Who do we share your data with?

Lawyers of ALIGN are bound by professional secrecy. As a general rule, ALIGN does not share personal data with third parties.

However, ALIGN may share personal data collected when such a transfer is necessary to fulfill the purposes detailed above and only:

When required by a legal obligation or a court order;
When necessary for the performance of our legal services to public authorities, bailiffs, notaries, experts, auditors, associates, or external collaborators…;
To suppliers such as IT suppliers, accountants, marketing companies…; when these suppliers have access to your personal data for the performance of their services, ALIGN concludes a data processing agreement to ensure an appropriate level of protection and security for your data.

Do we transfer personal data outside of the European Economic Area?

ALIGN does not transfer data outside the European Economic Area (“EEA”). However, if there is a requirement to transfer data outside the EEA, in line with the purposes described above, this transfer will be made in accordance with Articles 44 and following of the GDPR.

How long do we keep your data?

When we process your data for the performance of legal services, we keep your data as long as is necessary for the provision of the legal services, and, after our contractual relationship is terminated, we will keep your data as long as is necessary to meet our accounting, tax or other legal obligations.

The data necessary to meet our legal obligations regarding the fight against money laundering is kept for ten (10) years from the operation subject to the law on the prevention of money laundering and the financing of terrorism.

When we process your data for recruitment purposes, your data will be processed during the recruitment process and for a maximum of one year after the end of this process.

When we process your data for the other purposes described above, we will keep the personal data for a period of five (5) years from the last contact with the person concerned.

What are your rights, and how can you exercise them?

The following rights are recognised to data subjects, it being understood that their exercise may not affect the code of ethics, the professional confidentiality, the mission of the lawyer and/or the rights and freedoms of others.

Right of access

Any data subject can access the following information concerning them: categories of personal data collected, processing carried out and purposes thereof, categories of persons to whom the data have been or will be communicated, period of storage, rights relating thereto and the source of the data (when they were not collected directly from the data subject).

Right of rectification

Any data subject can ask ALIGN to correct and/or update personal data processed by ALIGN.

Right of deletion

Any data subject can ask ALIGN to erase personal data in the following situations:

personal data is no longer necessary for the reasons it was collected or processed;
the data subject has withdrawn their consent (when the processing carried out was based on said consent);
when the data subject considers that one of the processing operations being carried out does not comply with the GDPR, infringes their privacy and/or causes them excessive damage;
when the person concerned no longer wishes to receive commercial solicitations from ALIGN;
when personal data must be erased in order to comply with a legal obligation which is provided by European Union law or by national law to which ALIGN is subject.

However, ALIGN may not be able to grant a request for erasure (balance with other important rights or values, such as freedom of expression, compliance with a legal obligation to which ALIGN is subject or significant public interest grounds).

Right to limit the processing operations

Any data subject can ask for the limitation of the processing operations of their data in the following cases:

the accuracy of the data in question is disputed;
the data is not processed according to the GDPR and the Belgian or French law;
the data is no longer necessary to reach the purposes initially intended but cannot be deleted yet for legal reasons (as for instance, the exercise or the defense of rights in court);
the decision on a request to oppose the processing is pending. In case of limitation of processing operations, the personal data in question will no longer be subject to any processing without the prior consent of the person concerned, except for the storage. Said personal data may nevertheless still be processed for the establishment, exercise or defense of rights in court, or for the protection of the rights of another legal or natural person, or even for important reasons of public interest.

Right of opposition

Any data subject concerned may object to the use of their personal data for commercial solicitation purposes. Such a request cannot be granted if the processing carried out is necessary for the conclusion or execution of a contract, if it has been required by law or if it is necessary to establish, exercise or defend rights in court.

Right to data portability

Any data subject can recover any personal data processed by ALIGN for their personal usage or ask ALIGN to transfer any personal data to another company if such a transfer is technically possible. This right does not apply to data that would have been created by ALIGN. Such a request cannot be granted if this right violates the rights and freedoms of third parties.

We will do our best to answer your questions to the extent possible and as soon as possible.

If you are not satisfied with the answer of ALIGN , you can complain to the competent data protection authority (in Belgium, the Data Protection

Final provisions
